I am licensed to practice law in the Commonwealth of Massachusetts and have practiced law for over 25 years. My wife has numerous family members who live, work and own a business in Maine and we visit Maine regularly. Our oldest daughter long held a Registered Maine Guide License.
To this lawyer's eyes, this record smells to high heaven of prosecutorial misconduct. How this prosecution has been allowed to continue this long is unfathomable. That it has, has caused me to have second thoughts about the quality of the bar in Maine, the quality of bar oversight in Maine, and the quality of law enforcement in Maine. It is noteworthy that both the Trial Court and the Maine SJC took a pronounced, dim view of the prosecutor's actions in this case. That the prosecutor appealed the new trial order to the Maine SJC certainly strikes one as unusual. That the prosecution has continued on this record even after the rebuke from the Maine SJC is appalling. I urge you to do justice in this case and make it clear that all persons who live or visit Maine will receive equal protection of the law, without discrimination, and that prosecutors in Maine are expected to be honest prosecutors, and not persecutors.”

Elam and his fellow activists have fought back by creating their own website, "Register Her," which purports to be a public database of false accusers, violent female offenders and even public figures who have advocated against men.

One of Elam's more prominent targets among the latter is Mary Kellett, an assistant district attorney in Maine, whom the site calls a "corrupt public official" who "has distinguished herself by prosecuting numerous cases of rape and domestic violence against men within her community based on no evidence." Calls for comment to Kellett's office were not returned.”

SAVE has sent a letter to Maine’s Attorney General William J. Schneider calling on him to:

1. Mandate the removal of no-drop prosecution policies in the State of Maine.

2. Emphasize prosecutorial respect for the ethical requirement that “the prosecutor shall refrain from prosecuting a criminal charge that the prosecutor knows is not supported by probable cause.”

3. Remove misleading DV information from the Office of the Attorney General website.

No-drop prosecution policies make a mockery of “innocent until proven guilty,” fill court dockets with trivial cases, and ultimately squander scarce prosecutorial resources.

The misrepresentation of domestic violence research on the Attorney General’s website may serve to bias prosecutorial decision-making, as well. This is probably what happened in the case of Vladek Filler. Even though credible testimony revealed Ligia Filler once punched her husband in the face, prosecutor Mary Kellett refused to charge the woman with assault.

SAVE is now calling on persons to contact Attorney General William J. Schneider with a message like this:

SAVE has sent a letter to District Attorney Carletta M. Bassano calling for the immediate dismissal of the case of State of Maine v. Vladek Filler.

This case represents a bizarre miscarriage of justice that threatens to undermine public respect for law:

The allegation of marital rape does not meet the probable-cause standard.
Ligia Filler is a proven child abuser.
Ligia Filler is a documented false accuser.
The Maine Department of Health and Human Services sided with the defendant in a concurrent child custody dispute.
Continued prosecution of the case is likely to harm the children.
The case has become so tainted with bias that justice can no longer be served.
The continued prosecution of this case re-victimizes the true victims of violent crime.

SAVE has filed a Complaint with the Maine Board of Overseers of the Bar . The Complaint concludes:

“Mary Kellett’s repeated instances of prosecutorial misconduct has had the effect of undermining public respect for law. She is dangerous to the even-handed administration of justice. Kellett has been shown to be an enabler of a known perpetrator of child abuse. Therefore, prosecutor Kellett’s actions demand disbarment by the Maine Board of Overseers of the Bar in order to assure the safety and tranquility of the citizens of Maine.”

“No drop” prosecutions are becoming a plague in the American judicial system. The term refers to a case that a prosecutor will pursue at all costs, even if it means the knowing conviction of an innocent person.

Right now in the state of Maine one of those prosecutions has led to the harassment and abuse of Vladek Filler and quite likely a number of other innocent men.

The persecution of Vladek Filler stems from a ten year old accusation backed by no evidence other than the word of the mother of Vladek’s children. There is no credible evidence that we know of, none, to support her allegation.

Prosecutor Mary Kellett prosecutes many similar cases perhaps driven by the radical feminist ideological belief that a woman is to believed at all cost, even if there is a plethora of substantive evidence which overwhelmingly establishes reasonable doubt or vindicates the accused.

The Filler case is an egregious miscarriage of justice. He was convicted on an “absence of evidence” and Kellett successfully was able to keep evidence that favored Vladek away from the jury. So egregious was her misconduct that the Maine Supreme Court remanded the case for retrial. After filing complaints with the Governor of Maine and Maines Bar of Overseers of the Bar NCFM issued this press release: NCFM press release re Vladek Filler in Maine. I was left thinking one thing after reading Bill Trotter’s article in the Bangor Daily News.

Not good enough.

I am as pleased as anyone that a loyal member of the MSM machine actually published the fact that there are serious concerns being expressed about the integrity of the prosecutions emanating from the Bar Harbor, Maine prosecutors office. That is especially true considering the alleged targets are male and the prosecutor is a woman and the alleged crimes are rape and domestic violence.

But as I read I got this feeling that I was being tossed a bone and expected to take it to the corner of the room with my tail wagging. Am I the only one who noticed that the headline of this piece had nothing to do with the real story? Why is the headline about a change in venue when we have complaints filed against the prosecutor in the case; the same prosecutor whose ill-gotten conviction of Vladek Filler was overturned, citing prosecutorial misconduct?

Why no mention of several things that are a matter of public record? Ligia Filler is a known child abuser. Ligia Filler was the only proven or even credibly alleged person to be a violent assailant in her marriage. Ligia Filler is a proven liar that has already been caught in false accusations of abuse against her husband.

Where is one shred of investigative intent in the article?
